Well, if you read my previous post, you know that kaiser's attorney's were threatening my friend with charging her for practicing law without a license. Then they said she wasn't allowed to appear in court with her father, who is disabled, can't walk and needs oxygen to speak.

Let me tell you that in 1998, the Supreme Court admonished Kaiser saying, "There is evidence that Kaiser established a self-administered arbitration system in which delay for its own benefit and convenience was an inherent part, despite express and implied contractual representations to the contrary." In English that means that they would try to delay the case until the patients statute of limitations ran out. Kaiser promised to overhaul the system to make it more responsive to patients. There are still significant hurdles for patients who have legitimate claims seeking to prevail in kaisers arbitration system that don't exist in a court. One of the biggest hurdles is that they keep these hearings secret, and they depend on arbitrators who have a financial interest in receiving repeat business from Kaiser. As a result of the systems disadvantages many patients are unable to find attorneys to represent them in Kaiser's arbitration hearings.

So, if this man cannot find an attorney, shouldn't he have someone there to represent him? He can't speak for himself. Well, The American Arbitration Association, the American Bar Association, and the American Medical Association Due Process Protocol says patients have the right to be represented by an attorney or A SPOKESPERSON OF THEIR OWN CHOOSING.

Kaiser should not stray from these rules. But it does. By trying to prevent my friend from helping her father, they are breaking the rules.

This is a place where you are supposed to get help. These Doctors supposedly take an oath to do no harm. Is medicine becoming such big business that they risk patients? So many people have come to me with horror stories about kaiser, that it seems unreal. Especially the Hayward Kaiser. One woman gave birth to a child, and when the nurses put the iv in, they didn't get the needle in the vein. The patient saw it puffing up and it hurt a lot. The nurses said, "Oh its nothing to worry about." She had 2 fingers amputated, had to have her hand grafted to her hip for six months to grow new skin, and has never even been able to change her own child's diapers. Don't worry, rrrriiiight.

Something needs to be done. Kaiser needs to be punished not reprimanded.

Hey, I haven't been here for a while. I got so tired of Kaiser, and all the garbage that I couldn't write anymore. Well, I'm rested up now, and I have lot's more to tell you. Kaiser's attorneys are really kicking up the bull now. First they have sent a letter saying they want my friend to be charged with a crime for trying to help her dad. They say HE is negligent because he isn't handling his own case, and that she is practicing law without a license. How can a man who is now a vegetable handle his own case???? Now, they have sent a second letter requesting that he come to court next month on his own. They say that my friend is a threat to the Doctors, and they are afraid to come to court if she is there. Oh my God. So now they want the poor guy to come to court alone. Of course he can't walk, he can't talk well anymore, he is literally unable to appear by himself. How is the poor man supposed to defend himself? One of the letters sent had some quotes from some of the Kaiser staff that were supposedly involved with this family. When my friend read this letter, she couldn't believe it. The first social worker that dealt with the family was compassionate, and helpful. All of a sudden, she disappeared and when asked, Kaiser said she was ill that another social worker would take her place. This social worker is 100%behind Kaiser. The first doctor that put this man in TCU (after fussing from the family)is suddenly gone from the witness list. This doctor isn't even on the medical board. Then there is the room mate of my friends dad, and his wife. She witnessed the fact that they kept taking the heart monitor from him. She let my friend know that and when she asked the Dr. about it, that Doctor said that it was the only working heart monitor on the whole 4th floor. There is much more my friends. Kaiser's arbitration is so one sided it isn't even funny. It is impregnable, and a farce. What happened to the oath that these Doctors swear to when they become Doc's? I believe that it says they will do no harm. But, oaths sworn to God aren't as important as big business. By the way, one of my friends friend of 30 years passed away a couple of weeks ago from cancer that Kaiser failed to find. Wake up people. If you have Kaiser insurance, you need to be careful. Watch your doc's like a hawk, if you think something isn't right, say so. But remember, they will flag your chart saying that you are a trouble maker. And I mean that. After my Grandfather was misdiagnosed by Kaiser, I started fussing, and when the doc went out of the room, I was able to glance at his chart. In there was a big red sticker that was next to my name, saying that I could be a problem. Fine, let em flag me. I didn't shut up then, and I ain't a gonna shut up now. They can send their threats, I don't care, not when I know I am standing up for people who need my big mouth. Watch out, they may come after you.......

NOT NOW, I'D RATHER GO UNCOVERED THAN USE THAT BUTCHER SHOP. PLEASE AT LEAST MAKE AN INFORMED CHOICE. KNOW WHAT YOU ARE GETTING INTO. IF YOU SIGN ON THE DOTTED LINE WITH KAISER, YOU SIGN AWAY YOUR RIGHTS. IF THEY DO YOU WRONG, YOU HAVE NO PROTECTION. THEY DON'T CARE ABOUT YOU.
